Heard learned counsel for the parties.We have referred the matter to mediation which has failed.
After giving consideration to the statement made by learned counsel for the parties, it is in the interest of justice that the petitions filed by the respondent Moukhi Dutta (Ghosh) under Section 125 of Code of Criminal Procedure, 1973 being case No.Misc.175/2012 and 176/2012 titled as Moukhi Dutta (Ghosh) vs. Dipankar Ghosh pending before the Court of Family Judge, Agartala, Tripura West and petition under Section 12 of the Protection of Women from Domestic Violance Act, 2005 being Case No C.R.83/2012 titled as Moukhi Dutta (Ghosh) vs. Dipankar Ghosh & Ors. pending before the Chief Judicial Magistrate, Agartala, Tripura be transferred to District & Sessions Judge, Hyderabad.
We request the court concerned at Agartala to send forthwith the record of all the cases to the learned District & Sessions Judge, Hyderabad who shall transfer the said record to the competent court to decide the cases.
In the facts and circumstances of the case, we request the concerned court where the matter is sent to decide the cases expeditiously preferably within a period of four months from the date of first appearance of parties before him.With these observations, the Transfer Petitions stand disposed of.
