Non-Availability Of Birth Certificate For Late Registration

The non-availability of birth certificate is issued when the person does not have a birth proof. One can visit the municipal corporation, gram panchayat or chief medical officer in the area where he or she is born and apply for this document, showing address proof and proofs of 2 more witnesses on an affidavit.

Birth registration is elementary procedure to ensure his access to ancillary services, such as healthcare and education, provided by the government. In a few cases, parents forget to register their ward’s birth with the Registrar General. There are some cases wherein people lose it to fire, flood or any other calamity. In that case, they need to get a non-availability of birth certificate (NABC).

Simply say, NABC is a legal document provided as an alternative to re-register your birth with the Municipal Corporation.

Who issues it?

  • The Registrar General in India is the central authority to issue it. The state has its own Chief Registrar who registers births and deaths. In his absence, there is a sub-registrar to take charge.
  • In villages, this authority passes to the Panchayat Department.
  • Para-medical staff is there in every village to issue this provisional birth proof.
  • The Tehsildar at the Taluka level also has authority to issue it.
  • If the birth has taken place at Home, the nearby vaccination centre can be the place you can visit and get the letter. Get it on the letter head on which the head of the family and 2 other witnesses’ should have mentioned themselves as a witness of your birth.
  • If you are born in a vehicle, the registration center at the pace it first stopped will be the place where you should go for seeking birth proof.
  • If your birth place is a jail, the letter issued by the jail in-charge will be his birth proof.
  • If you took birth in a dharmashala/ boarding house, the head of that place will serve the purpose of proof to apply in MC.

The legislation reads that those who are born after 26 January 1989, have to get birth certificate. It is compulsory if you want to apply for a passport.

Section 17 of Registration of Birth & Death Act, 1969

Under this act, the NABC will help you to get off the challenges in accessing basic services. It sets ground to apply for birth certificate because it is a proof of unregistered birth. This is the civil right to have it.

How can NRIs get it?

It’s good to hire an attorney or a lawyer to apply for this certificate for speedy procedure. There may raise a need for the court verification. So, you should have the requisite documents to support that yours is an unregistered birth or you have lost your birth certificate.

Documents to Enclose With Application

  •  10th class mark sheet/ school leaving certificate
  •  PAN card/ voter id/driving license/ Aadhaar card
  •  Address proof
  •  Photographs of the child and parents

You should keep photocopies of these documents along with. When the magistrate will ask to cross check, show them up for verification. These can be required when the magistrate issues an affidavit with notary stamp.

Application Procedure

  • Visit Municipal Corporation in your area.
  • Apply with the Registrar of birth and death in Registration office.
  • Enclose all aforementioned documents with affidavit that has the signature of the gazette officer.

Payment for Issued Certificate

It may vary from state to state. However, this cost would be higher than that of the birth certificate which one should generally get in 21 days of the birth. The mode of payment can be cash or debit card.

Verification

When you apply for it, the inquiry at the background will take place. It may take a week or more than that. If you are an NRI, you can assign this authority to one of your relatives.
